Apply for Customs Protection?
According to the Regulations of the P. R. China on Customs Protection of Intellectual Property Rights, an IPR holder may request the Customs to take protective measures for their IPRs in two modes of "Protection Ex Officio" or "Protection on Request".
Protection Ex Officio, also called Customs “Proactive Protection”, refers to the enforcement procedures that the Customs has the power to proactively start to stop and investigate the import/export infringing goods and impose penalty on the infringers. Protection on Request, also called Customs “Passive Protection”, refers to the enforcement procedures that the Customs will start on the request by the IPR holders.
