I. Conditions for a customs broker to apply for the Permit for Registration of a Cross-Customs-Districts Branch:
A customs broker that applies for a registration permit for a branch shall:
(1). have held the Customs Declaration Registration Certificate of the People’s Republic of China for Customs Broker (see the Appendix 1) as approved and issued by the Customs for at least two years; and
(2). have not been punished for smuggling within 2 years as of the date on which the customs broker has filed an application.
A customs broker that applies for registration permit for a cross-customs-districts branch shall add RMB 500,000 to its registered capital.
II. Conditions for such a branch to obtain the permit for registration:
A cross-customs-districts branch established by a customs broker that plans to obtain registration permit shall meet the following conditions:
(1). meet the conditions for the establishment of a branch by an enterprise legal person within the territory of China;
(2). have no less than 3 customs declarers;
(3). have a fixed site for business operation and facilities necessary for providing customs declaration services;
(4). appoint a person in charge of the branch with no less than 5-year experience in foreign trade or other relevant experience in customs declaration; and
(5). the person in charge of customs declaration and the customs declarants have no involvement in smuggling.
III. Application materials
(1). the application form for registration permit for a cross-customs-districts branch of a customs broker;
(2). copies of the Customs Declaration Registration Certificate of the People’s Republic of China for Customs Broker;
(3). a feasibility report on the provision of declaration services by the branch;
(4). copies of the Declarer's Qualification Certificates for the customs declaration practitioners proposed to be employed by the branch;
(5). the resumes of the person in charge of the branch and the person in charge of customs declaration;
(6). the ownership certificate or lease agreement for the customs declaration premises;
(7). materials certifying that the customs broker meets the conditions for application for registration permit for a branch as issued by the directly competent customs; and
(8). any other materials required for application for registration permit for the branch.
IV. Application Site
Where a customs broker applies for registration permit for a cross-customs-districts branch, it shall submit the application materials to the Customs in the place where the branch is located.
V. Time limit for handling of application
Following the acceptance of an application by the Customs in the place where the branch is located, it shall thoroughly inspect the application materials on the basis of the applicable statutory conditions and procedures and complete the inspection within 20 days as of the date on which the application for registration permit is accepted, and shall subsequently submit its inspection comments and all the application materials to the directly competent customs.
The abovementioned customs shall make a decision on the application within 20 days as of the date on which it has received the inspection comments submitted by the local Customs.
