Item under administrative license: Registration of domestic enterprises and vehicles transporting the goods under Customs supervision 

Contents licensed: 
The Customs permit the activities of certain transportation enterprises and vehicles undertaking goods under Customs supervision. 
Basis for establishment: 
Item 228 of the Decision of the State Council to Set Administrative Licenses for Items Requiring Administrative Approval that Really Need to Be Reserved (Decree No. 412 of the State Council) 
Basis for implementation:  
1. Administrative License Law of the People's Republic of China 
2. Measures of the Customs of the People's Republic of China on Implementing the Administrative License Law of the People's Republic of China (Decree No. 117 of the General Administration of Customs)  
3. Administrative Measures of the Customs of the People's Republic of China for Domestic Transportation Enterprises, Vehicles and Drivers for Road Transportation of Goods under Customs Supervision (Decree No. 88 of the General Administration of Customs issued in September 2001, revised according to Decree No. 121 of the General Administration of Customs in November 2004) 
4. Regulatory Measures of the Customs of the People's Republic of China for Containers and Container-like Vans Used for Loading Goods under Customs Supervision (Decree No. 110 of the General Administration of Customs) 
5. Other laws, administrative regulations, rules and normative documents 
Application requirements:  
(I) Transportation enterprises undertaking goods under Customs supervision  
1. With more than 1 year of goods transportation experience and more than RMB 2 million of registered capital;  
2. Legal persons or other organizations or citizens capable of providing guarantee for performing customs affairs, in accordance with provisions specified in Customs Law of the People’s Republic of China; 
3. Financial systems and accounting management systems of the enterprises complying with relevant state regulations;  
4. Favorable enterprise credit and no criminal record in the history of transportation service;  
5. Other requirements as specified by laws and administrative laws and regulations.  
(II) Vehicles undertaking goods under Customs supervision  
1. In principle, vehicles shall be container-like vans or container tractors, but bulk-freight trucks are allowed with the approval of Customs;  
2. They are the self-owned vehicles of transportation enterprises, and names of vehicle owners on the Motor Vehicles Registration Certificate must be consistent with those of their transportation enterprises;   
3. Wagons of container-like vans shall be firmly fastened to the frames, and be equipped with metal structure capable for sealing and without concealed compartment and partition. Screws used to connect the wagons shall be totally welded, while the two pieces of doors on the back of the wagon shall be stuck with steel plate to ensure closeness after sealing. Any special need to add a side door shall be subject to approval and regulatory requirements of the Customs; 
(Wagons of container-like vans shall meet the requirements as specified in Regulatory Measures of the Customs of the People's Republic of China for Containers and Container-like Vans Used for Loading Goods under Customs Supervision) and shall obtain Certificate of Approval for Wagons of Container-like Vans issued by China Classification Society.) 
4. Container tractors shall carry containers meeting relevant international standards;  
5. Bulk-freight trucks shall only carry large bulk goods without sealing conditions, such as ore sand, food and ultra-large mechanical equipment;  
6. Vehicles engaged in transportation of special goods shall present certificate of approval by competent authorities;  
7. Other requirements as specified by laws, administrative regulations and rules.  
Documents to be submitted upon application:  
(I) Registration of transportation enterprises  
1. Application for Registration of Domestic Transportation Enterprises Undertaking Transportation of Goods under Customs Supervision (Annex 1);  
2. Copy of Business License issued by industrial and commercial administrations;  
3. Copy of Road Transport Business License issued by transportation management departments;  
4. Copy of Organization Code Certificate of the People's Republic of China issued by technical supervision departments;  
5. The list and registration documents of drivers of vehicles undertaking goods under Customs supervision; in case of any change of any driver, change recordation formalities of relevant drivers shall be timely handled at the Customs;  
6. Other documents and materials required by the Customs in accordance with relevant regulations.  
Documents mentioned under item 2, 3 and 4 shall be accompanied with the originals for the Customs’ check.  
(II) Registration of vehicles 
1. Application for Registration of Domestic Transportation Vehicles Undertaking Transportation of Goods under Customs Supervision (Annex 2);  
2. A copy of Motor Vehicles Registration Certificate issued by public security and traffic administrative department;  
3. A copy of Road Transport Business License and Road Transportation Operation Certificate stamped with “Special Seal for Road Transport of Dangerous Goods” for vehicles undertaking dangerous goods;  
4. 2 color photos of the vehicle (requirements including: 45 angle from the left front side, 4×3 cun; clear image of license plate number; name of the enterprise and “Customs Supervision” on the head and wagon side);  
5. The original Certificate of Approval for Wagons of Container-like Vans issued by China Classification Society for vans;  
6. Other documents and materials required by the Customs in accordance with relevant regulations.  
Documents mentioned under item 2 and 3 shall be accompanied with the originals for the Customs’ check.  
Handling Procedures:  
1. Transportation enterprises submit application documents for registration of the enterprises and their self-owned vehicles to the local supervisory customs, which will accept such applications with all required materials and in legal forms; 
2 The local supervisory customs make decisions on permission (subject to the review and approval of supervision department of Nanjing Customs) within 20 working days since the acceptance of application. For enterprises and vehicles approved for registration, “Approval for Registration” shall be stamped on the application forms and Certificate of Registration, Carry Permit and Vehicle Goods-undertaking Record will be issued. While for those disapproved, Letter of Decision of Disapproval (explaining reasons for disapproval) will be prepared and issued, and relevant applicants shall be notified that they have the right to apply for administrative reconsideration or initiate an administrative litigation;  
3. Transportation enterprises and vehicles undertaking goods under Customs supervision are subject to the annual verification by the Customs, and the annual verification will be accomplished by the end of May each year;  
4. Registration formalities shall be handled again in case of any change of vehicle (including change in vehicle, engine and license plate number) or modification of vehicle body;  
5. Where any transportation enterprise or its vehicle is no longer engaged in transportation activities of goods under Customs supervision, such enterprise shall return Certificate of Registration, Carry Permit and Vehicle Goods-undertaking Record to the registration Customs and handle relevant procedures.
