Without careful examination, the two trademarks “AIR MAX” and “ATR MAX” are too similar to be distinguished from each other. On August 2, the trademark “AIR MAX” owner NIKE Innovate Company, by writing to Xiamen Customs, confirmed 1,872 pairs of casual shoes seized a few days ago as IPR-infringing shoes by similarity and requested IPR enforcement, marking the first trademark similarity infringement cracked by Xiamen Customs in recent years.
Recently, a trading company from Quanzhou city declared to Xiamen Customs for exporting casual shoes. By routine inspection, Customs officers found out that the goods package printed with the mark “ATR MAX”could be easily confused with Customs-registered trademark “AIR MAX”. By repeated comparison, these shoes were basically the same as the registered shoes in terms of style, thus suspected of infringing on trademark “AIR MAX”.
Since the consignor could not provide relevant authorization proof, the Customs immediately informed the trademark owner and finally confirmed the infringement.
