Title of administrative licensing item: approval of settlement articles of admitted incoming visitors

Contents:

The Customs approves an admitted incoming visitor to carry his or his family’s articles necessary for daily use during the stay within the territory of China.


Establishment basis:

Item231 of Decisions of the State Council on Establishing Administrative Licensing for Administrative Examination and Approval Items needed to be Retained (Decree of the State Council No.412)


Implementation basis:

 5. Other laws, administrative regulations, rules and normative documents
Application requirements: 
(I)Admitted incoming foreign visitors with the intention of settling down (Decree of the General Administration of Customs No. 9 is applicable)
1. An Applicant refers to foreign visitors that have immigrated in the territory of China with the settlement certificate or approval documents issued by the competent authority of the People's Republic of China.
2.Articles of settlement applied for import are articles that the Applicant has possessed and used and are necessary for daily use during his staying within the border(the import of articles for self-use of reasonable amounts is allowed without taxes whereas one car for self-use for each household is permitted with tax).
3.Articles of settlement applied for import may not include articles the entry and exit of which are prohibited or restricted by the state.
4. Other conditions prescribed by laws, administrative regulations and rules.
(II)Admitted incoming Chinese non-resident visitors with the intention of settling down (Decree of the General Administration of Customs No. 58 is applicable)       
1. An Applicant refers to Chinese non-resident visitors such as overseas Chinese, Taiwan compatriots, Hong Kong and Macao compatriots settling down within the territory of China as approved by the settlement certificates or approval documents issued by a competent authority of the People's Republic of China.
2. Articles of settlement applied for import are articles and vehicles for self use that the applicants have abroad and have used (the entry of self-use articles at reasonable amount is permitted without tax upon the approval of Customs; for the articles with a duty-paid price of over RMB 1,000 and less than RMB 5,000(RMB 5,000 inclusive), only1 item per type is allowed). Self-use articles falling into the List of Taxable Articles for Self Use and Settlement of Settled Visitors shall be subject to taxes. Each household is allowed to carry one self-use car and motorcycle, on which the Customs will levy taxes in accordance with regulations.
3. Articles of settlement applied for import may not include articles the entry and exit of which are prohibited or restricted by the state.
4. Other conditions prescribed by laws, administrative regulations and rules.
Documents to be submitted upon application:
1.Application Form of the People's Republic of China for Inbound and Outbound Articles for Self-use(Annex 1);
2. Settlement certificates or approval documents issued by competent authority of the People's Republic of China;
3. Certificate of identification of the applicants;

4.List of inbound articles as applied;


5. Other documents and materials required by the Customs as prescribed.
Procedures:
1. Applicants fill in the application form and lodge complete application materials in conformity with legal form to the Customs, then the Customs accept the same(Applicant who are Chinese non-resident visitors shall, within 3 months after having settlement approval, file an application to the competent authority of his settlement place with the settlement certificate issued by relevant competent departments the People’s Republic of China);

2. The Customs will finish approval within20 working days from the acceptance of an application and make decisions: for those permitted applicants, “Entry Permitted” will be directly marked on the application form; otherwise, a letter of non-permission, indicating the reasons will be prepared and issued and the applicant will be notified of his right to apply for administrative reconsideration or bring an administrative litigation in accordance with the law;

3.The applicant shall handle specific inspection and release procedures in the Customs where the articles are imported with application forms and the opinion of “Entry Permitted” of competent customs (Permitted inbound articles and vehicles for self-use of applicants who are Chinese non-resident visitors shall be imported from the approved port within six months from the date of approval);

4. From the date of entry, for incoming visitors for settlement who domestically reside for less than 2 years and exit for settlement again, their inbound settlement articles carried without taxes shall be exported again. Otherwise, they shall pay the evaded tax to the Customs.

Other notes:
In the case of inconsistency between the content hereof and the current laws, administrative regulations, rules and normative documents of the General Administration of Customs, the latter shall prevail.
