Article 1 Where a customs broker or a consignee or consignor of imported or exported goods (general import and export enterprises) violates the Administrative Provisions of the Customs of the People's Republic of China on the Registration of Customs Declaration Agencies, the Customs shall punish it in accordance with the Customs Law of the People's Republic of China and the Implementing Regulations of the Customs of the People's Republic of China on Administrative Penalties; if a crime is constituted, criminal liability shall be prosecuted by law.
Article 2 When a customs broker or a consignee or consignor of imported or exported goods (general import and export enterprises) falls under any of the following circumstances, the Customs shall warn it and order it to take corrective steps, and may impose a fine of between RMB 1,000 and RMB 5,000:
1. After the customs broker has obtained the license for alteration of registration or the consignee or consignor of imported or exported goods has made alterations in its registered information with the Customs such as firm name, business nature, domicile and legal representative (person-in-charge), they fail to go through the formalities for their alterations with the Customs;
2. The customs broker or the consignee or consignor of imported or exported goods arbitrarily change or use their special seal for customs declaration without registration with the Customs; or
3. Where any of their subordinate customs declarants resigns, the customs broker or the consignee or consignor of imported or exported goods fail to notify the Customs of the resignation and to go through relevant formalities.
