Customs Clearance Suspension
Where the Customs find that any import/export goods involve any registered IPR during customs clearance, they have the power to take the following measures:
- · Verify that whether the importer/exporter or manufacturer is the legal user of the IPR registered with the General Administration of Customs or not, or require the consignee or consignor to declare the conditions of the IPR involved in the goods and to submit the relevant supporting documents within a prescribed time limit.
- · Where the importer/exporter or manufacturer is not the legal user of the IPR registered with the General Administration of Customs, or the consignee or consignor fails to declare the conditions of the IPR involved in the goods and to submit the relevant supporting documents, or the Customs have reason to believe that the goods are suspected of infringing an IPR registered with the General Administration of Customs, the Customs shall suspend the customs clearance procedures.
- · Inform the IPR holder of the suspension of clearance procedure in writing with the registered contact modes.
