Fee Settlement & Guarantee Refund
The IPR holder shall pay the actually incurred fees for warehousing, storage, disposal, etc. after the goods are detained by the Customs.
Where the IPR holder fails to pay relevant fees as required, the Customs may deduct the relevant expenses from the guarantee money paid by the IPR holder or request the guarantor to perform the guarantee obligations.
The Customs shall refund the guarantee money to the IPR holder or release the guarantor's liabilities after the disposal of the goods and the settlement of relevant fees. However, where the IPR holder causes any loss to the consignee or consignor due to its improper application filed to the Customs, the Customs may, according to the notification from law court, assist the IPR holder in compensating the consignee or consignor for such loss with the guarantee money offered by the IPR holder.
