Strengthening Customs IPR Enforcement to Protect Enterprise Innovation
[Qiao Jinming]: According to your description, there may be the risks of infringement. Where a trademark does not apply for IPR protection to the Customs, it doesn’t represent there is no trademark registration. Without the authorization of trademark registrant, the act to produce and export the goods is likely to constitute infringement. So, for export of IPR-related goods, despite customs registration, we shall pay attention to the source and authorization. 04/25/2014 11:06:38
[Netizen: anonymity]: Hello! I am from a customs broker in Jiangmen. I want to ask a question: if the brand of the goods for export by my customer is partially similar with a brand registered at the Customs, for example, “ABCD” is the registered one, and “BCD” is our product brand. In this case, could my company accept to provide customs declaration services? 04/25/2014 10:46:23
[Qiao Jinming]: Your question relates to judgment of similar trademark. To judge a similar trademark, we need to make a comprehensive judgment according to sound, form and meaning of the trademark. If the trademark is judged as a similar trademark, it infringes on the registered trademark. 04/25/2014 11:07:05
[Netizen: anonymity]: Good morning! The brand for a batch of exported goods of my customer is similar with a brand registered at the Customs. Could Jiangmen Customs provide a method for consulting? 04/25/2014 10:53:19
[Qiao Jinming]: Of course! If you are in Jiangmen, please call at our customs service hotline: 12360. If you are in other cities, please add the area code 0750 before 12360. Our expert can solve your problems. 04/25/2014 11:13:42

[Liu Yang]: Bye! 04/25/2014 11:14:31
