Strengthening Customs IPR Enforcement to Protect Enterprise Innovation
[Wang Hua]: Sharp increases! But it seems to me that the value of goods seized is not so stunning given the large size of the seizures. 04/25/2014 10:15:42
[Qiao Jinming]: Yes! It’s because the infringing goods we seized are mainly light-industry products produced by local enterprises, such as batteries and hardware products. This fits in with the industrial structure of Jiangmen customs district. What we did is a great protection to domestic industrial brands. 04/25/2014 10:16:21
[Qiao Jinming]: Moreover, all the infringement cases detected share things in common, for example, they all fell in the category of infringement upon the exclusive right to use trademark; the goods seized were exported mainly to Southeast Asia, the Middle East and Europe, as normal trade goods; and all the goods were seized in goods control. 04/25/2014 10:17:14
[Wang Hua]: This also reflects the regional characteristics of Jiangmen. Mr. Qiao, what measures have been taken by Jiangmen Customs District, a government agency that supervises entry and exit, to protect corporate intellectual property rights? 04/25/2014 10:17:43
[Qiao Jinming]: Firstly, we provide effective support. We increase input in man-power, materials and financial resources, establish a special protection agency of IPR, designate Customs officers to take care of the issues on Customs IPR enforcement,, so as to ensure all the related assignments will be carried out in a down-to-earth manner . 04/25/2014 10:18:05
[Qiao Jinming]: Secondly, we do well on publicity. We continue to run the campaign of popularizing IPR laws in organs, in rural areas, in urban communities, in schools, in enterprises, and in public institutions. We also held other activities such as “4.26 Intellectual Property Rights Publicity Week”, “8.8 Customs Legal Publicity Day” and “12.4 Legal Publicity Day” to make known the basic knowledge, helping import and export enterprises and the concerned understand better the laws and regulations as well as import and export policies on Customs IPR enforcement. 04/25/2014 10:18:36
[Qiao Jinming]: Thirdly, we offer quality services. We give more support to domestic enterprises which have their own IPRs, and encourage and guide them to have their IPRs recorded with the General Administration of Customs of China, especially such IPRs as the well-known trademarks and products with competitiveness. Through all these services, we intend to support the efforts made by the enterprises to protect their legitimate rights. 04/25/2014 10:19:09
[Qiao Jinming]: Furthermore, we also monitor specially those principal enterprises and sensitive commodities which we have picked up based on the analysis and evaluation done beforehand on the domestic reputable manufacturing industries under the jurisdiction of Jiangmen Customs District, trying to safeguard the legitimate rights and interests of proprietary brands. 04/25/2014 10:19:49
[Wang Hua]: What about the effects of the above-mentioned measures? 04/25/2014 10:20:40
[Qiao Jinming]: Good effects have been achieved in crackdown on IPR infringements. Here are the data from January 2011 to now. Jiangmen Customs has seized 198 consignments of suspect infringing goods, with a quantity of 15.87 million pieces and a total value of RMB 16.84 million. We successfully protected 130 IPR items from 23 countries and regions, including some world-famous trademarks, domestic independent brands, and domestic patented products. 04/25/2014 10:22:32
